2. Definitions

In these Terms and Conditions:

3. Our Contract with You

3.1. All orders placed through our website are subject to acceptance by us. We may refuse to accept an order for any reason, including but not limited to: product unavailability, errors in pricing or product information, or suspected fraudulent activity.

3.2. When you place an order, you will receive an email acknowledging receipt of your order. This acknowledgement does not constitute acceptance of your order.

3.3. A legally binding Contract between you and us is formed only when we dispatch the Goods and send you a dispatch confirmation email.

3.4. If we are unable to fulfil your order, we will notify you as soon as possible and offer you a full refund of any payment already made.

4. Pricing and Payment

4.1. All prices displayed on our website are in pounds sterling (£) and include VAT at the current rate (where applicable). Ex-VAT prices are also displayed for business customers.

4.2. We take reasonable care to ensure that prices are correct at the time of publication. However, errors may occur. If we discover an error in the price of Goods you have ordered, we will contact you to inform you of the error and give you the option to continue with your order at the correct price or cancel your order for a full refund.

4.3. Payment must be made at the time of ordering via the payment methods available on our website. We accept major credit and debit cards, and other payment methods as displayed at checkout.

4.4. All payments are processed securely through our payment provider. We do not store your full card details on our systems.

4.5. Goods remain our property until payment has been received in full.

5. Delivery

5.1. We aim to dispatch all in-stock items the same working day for orders placed before [insert cut-off time]. Delivery timescales are estimates only and are not guaranteed.

5.2. Delivery options and costs will be displayed at checkout before you complete your order.

5.3. Risk in the Goods passes to you upon delivery. If no one is available to accept delivery, the carrier may leave the Goods in a safe place or with a neighbour. Once this occurs, risk passes to you.

5.4. We are not responsible for delays caused by circumstances beyond our reasonable control, including but not limited to: adverse weather conditions, carrier delays, industrial action, or natural disasters.

5.5. If delivery is delayed by more than 30 days, you may cancel your order and receive a full refund.

6. Your Right to Cancel (Consumer Contracts Regulations 2013)

6.1. If you are a consumer, you have the right to cancel your order within 14 days of receiving the Goods without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

6.2. To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., email or letter) before the 14-day period expires.

6.3. If you cancel your order, you must return the Goods to us within 14 days of notifying us of your cancellation. You are responsible for the cost of returning the Goods unless they are faulty or misdescribed.

6.4. We will refund you within 14 days of receiving the returned Goods or evidence that you have returned them, whichever is earlier.

7. Condition of Returns

7.1. To qualify for a full refund, electric motors and associated equipment must be returned in unused condition with all original packaging intact.

7.2. Electric motors that have been installed, wired, powered on, or used in any way cannot be accepted for return. This is because we cannot legally resell such products as new, and we cannot verify their condition or guarantee their performance for future customers.

7.3. Returned items must include all accessories, documentation, and components originally supplied.

7.4. We reserve the right to deduct an amount from your refund to reflect any diminution in value of the Goods if this results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Goods.

8. Faulty Goods and Your Statutory Rights

8.1. Under the Consumer Rights Act 2015, you have statutory rights if Goods are faulty, not as described, or not fit for purpose:

  • Within 30 days: You are entitled to a full refund
  • Within 6 months: We will repair or replace the Goods. If repair or replacement is not possible, you are entitled to a full refund
  • After 6 months: You may still be entitled to a repair, replacement, or partial refund if you can demonstrate the fault was present at the time of delivery

8.2. These statutory rights apply in addition to any warranty we provide and do not affect your legal rights.

8.3. For faulty items, we will cover reasonable return postage costs.

9. Warranty

9.1. All electric motors supplied by MM Engineering Services (Yorkshire) Ltd come with a 12-month warranty from the date of delivery, covering defects in materials and workmanship under normal use.

9.2. The warranty does not cover:

  • Damage caused by improper installation, misuse, or negligence
  • Normal wear and tear
  • Damage caused by use outside the product's specified parameters
  • Modifications or repairs carried out by unauthorised parties
  • Damage caused by electrical supply issues, including surges or incorrect voltage

9.3. To make a warranty claim, please contact us with your order details and a description of the fault. We may request photographs or the return of the item for inspection.

10. Limitation of Liability

10.1. Nothing in these Terms and Conditions excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable law

10.2. Subject to clause 10.1, our total liability to you for any loss or damage arising from or in connection with the Contract shall not exceed the total price paid by you for the Goods.

10.3. We are not liable for any indirect, consequential, or special losses, including but not limited to: loss of profit, loss of business, loss of data, or business interruption.

10.4. We are not responsible for the suitability of products for your specific application. It is your responsibility to ensure that the products you order are appropriate for your intended use. Our team is happy to provide guidance, but any recommendations are given in good faith and do not constitute a guarantee of suitability.

11. Business Customers

11.1. If you are purchasing Goods in the course of a business rather than as a consumer, different terms may apply. In particular:

  • The Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 do not apply to business-to-business transactions
  • Our liability to you shall be limited to the price of the Goods purchased
  • We exclude all implied warranties and conditions to the fullest extent permitted by law
